《外国人在中国永久居留审批办法》所规范的对象是外国人，对现在已经在海外定居的华侨，从《外国人在中国永久居留审批办法》的原则来讲，如果现在仍然具有中国国籍、持有中国护照的华侨，不适用于这部管理办法。根据1986年颁布实施的《中华人民共和国公民出境入境管理法实施细则》的有关规定，已经定居在海外的华侨要求回国定居的话，可以直接向我国驻外的外交代表机构、领事机构提出申请，同时也可以由本人或者由国内的亲属直接向国内的拟定居地的省、自治区、直辖市的公安机关提出申请，公安机关受理之后，经过审核、批准，发给有关的回国证明，当事人持证明可以回国办理正式的定居手续。
